Delta-8 vs Delta-9 Gummies: What's the Difference?

Quick answer

Delta-8 and Delta-9 are both forms of THC. Delta-9 is the classic, stronger compound; Delta-8 is generally described as milder and smoother. Hemp-derived Delta-9 gummies are federally compliant when the product contains no more than 0.3% Delta-9 THC by dry weight.

Two forms of THC

Delta-8 and Delta-9 THC share almost the same chemical structure — the difference is the position of a single double bond. That small change affects how strongly each one binds to the body's CB1 receptors, which is why they feel different.

  • Strength: Delta-9 is the stronger of the two. Many users describe Delta-8 as roughly half as potent milligram-for-milligram.
  • Feel: Delta-8 is often described as clearer and more relaxed; Delta-9 as more euphoric and more intense.
  • Source: hemp-derived Delta-9 is extracted directly from hemp; most Delta-8 is converted from hemp-derived CBD.
  • Dosing: a 10 mg Delta-8 piece will usually feel lighter than a 10 mg Delta-9 piece.

What the 2018 Farm Bill says

The 2018 Farm Bill defines hemp as cannabis containing no more than 0.3% Delta-9 THC on a dry-weight basis. Because a gummy is heavy, a compliant product can still contain a meaningful milligram amount of Delta-9 while staying under that percentage.

Federal law is only part of the picture. Several states restrict or ban intoxicating hemp products, including Delta-8. We publish the list of states we don't ship to on our shipping page and at checkout.

Will either show up on a drug test?

Yes, potentially. Standard drug tests look for THC metabolites and generally can't tell Delta-8 from Delta-9 or hemp from marijuana. If you are subject to testing, avoid THC products of any kind.

Which one should you choose?

  • New to THC, or want something easygoing during the day: start with Delta-8 or a low-dose Delta-9 piece.
  • Experienced and want the classic effect: Delta-9.
  • Want a balanced, mellow experience: look at products pairing THC with CBD, such as our 1:1 infused popcorn.

Frequently asked questions

Is Delta-8 legal?

Delta-8 derived from hemp is widely sold under the 2018 Farm Bill, but a number of states have restricted or banned it. Always check your state's rules before ordering.

Is Delta-9 from hemp the same as Delta-9 from marijuana?

The molecule is identical. The difference is legal: hemp-derived products must stay at or below 0.3% Delta-9 THC by dry weight.

How much Delta-9 should a beginner take?

Start with 2.5–5 mg and wait at least 2 hours before taking more.
